US State Department Arrests Relative of Qassem Soleimani: Immigration Crackdown, National Security Concerns

Immigration Law and Revocation of Permanent Residency

The revocation of a green card is a serious legal action that typically requires substantial evidence. Under US immigration law, permanent residency can be revoked if an individual is found to have engaged in activities that threaten national security, support terrorism, or violate the terms of their residency.

In this case, the government appears to have relied heavily on the classification of the IRGC as a terrorist organization. Any support—material or rhetorical—for such groups can be grounds for removal proceedings.

Legal experts note that cases like this often hinge on the interpretation of “support.” While direct involvement in terrorist activities is clearly prohibited, the line becomes less clear when dealing with speech and online expression.

Legal Proceedings and What Happens Next

As of now, Hamida Soleimani Afshar and her daughter remain in ICE custody, awaiting further legal proceedings. Their case will likely involve immigration courts, where judges will determine whether the revocation of residency was justified and whether deportation is warranted.

These proceedings can take months or even years, depending on the complexity of the case and the availability of evidence.

Their legal team, if appointed or retained, may challenge the government’s claims, particularly regarding the interpretation of social media posts and the definition of support for a terrorist organization.
